The bill would also exempt certain entities from the definition of broker, including miners, stakers, and software developers.
The 2021 Infrastructure Law included a provision that requires cryptocurrency exchanges to report certain information to the Internal Revenue Service (IRS). The provision has been interpreted by some to include cryptocurrency exchanges that facilitate peer-to-peer (P2P) transactions.
This has led to concerns that cryptocurrency exchanges could be forced to collect personal information from users who engage in P2P transactions, even if those users do not have a U.S. tax identification number.
The Lummis-Gillibrand bill would clarify that cryptocurrency exchanges are not required to collect personal information from users who engage in P2P transactions.
The bill has been endorsed by the Chamber of Digital Commerce, a trade association representing the cryptocurrency industry.
"This legislation provides much-needed clarity for the digital asset industry and will help to ensure that the United States remains a global leader in innovation," said Chamber of Digital Commerce CEO Adam White.
The bill has not yet been introduced in the House of Representatives. If it is passed, it would represent a significant victory for the cryptocurrency industry.
