The lawmakers specifically asked the SEC to clarify whether cryptocurrency exchanges that facilitate the trading of digital assets are considered broker-dealers under the federal securities laws.
If exchanges are considered broker-dealers, they would be subject to a number of regulations, including requirements to register with the SEC and to comply with the anti-fraud provisions of the securities laws.
The lawmakers said that they are concerned that the current uncertainty about the regulatory status of cryptocurrency exchanges could stifle innovation in the industry.
"We believe that it is important for the SEC to provide clear guidance on the application of the federal securities laws to cryptocurrency exchanges," the lawmakers wrote. "This guidance will help to ensure that these businesses can operate in a compliant manner and that investors are protected."
The SEC has not yet responded to the letter from the lawmakers.
