Grayscale Investments, the world's largest digital asset manager, has filed a lawsuit against the U.S. Securities and Exchange Commission (SEC) over its decision to approve a Bitcoin exchange-traded fund (ETF) from ProShares.
In the lawsuit, Grayscale argues that the SEC's decision to approve the ProShares ETF was arbitrary and capricious, and that it violated the Administrative Procedure Act. Grayscale also claims that the SEC's decision is inconsistent with its previous decisions to deny other Bitcoin ETF applications.
Grayscale is seeking to have the SEC's decision overturned, and to have its own Bitcoin ETF proposal approved. The company has already filed a second Bitcoin ETF proposal with the SEC, which is currently under review.
The price of Bitcoin has soared to 27,600 USD in the wake of the SEC's decision to approve the ProShares ETF. This is the highest price that Bitcoin has reached since May of this year.
