The Securities and Exchange Commission (SEC) today charged three individuals with insider trading in connection with Long Island Iced Tea Corp.'s (LIIT) announcement that it would be pivoting to a blockchain-based company.
The SEC alleges that David Einhorn, founder of Greenlight Capital, tipped off two friends, Joseph Weingarten and Adam Weitsman, about the planned announcement. Einhorn, Weingarten, and Weitsman then allegedly purchased shares of LIIT in advance of the announcement, which caused the stock price to increase by more than 50%.
The SEC's complaint alleges that Einhorn, Weingarten, and Weitsman violated the antifraud provisions of the federal securities laws. The complaint seeks to recover the profits they earned from their illegal trades, as well as civil penalties.
"We allege that these defendants used confidential information to make a profit on LIIT stock," said Sanjay Wadhwa, Associate Director of the SEC's Division of Enforcement. "This type of insider trading undermines the integrity of our markets and we will vigorously pursue those who engage in it."
